Terms of Sale

1. Purpose

These Terms of Sale govern the provision, by ScamHunter.ch (the “Provider”), of investigation, OSINT analysis, flow tracing and document-preparation services for individuals or legal entities (the “Client”) who have suffered a scam or cyber-offence.

2. Nature of the service

The service qualifies as a mandate agreement within the meaning of art. 394 et seq. of the Swiss Code of Obligations (CO). The Provider applies the agreed diligence to research evidence and prepare a usable case file, without guaranteeing fund recovery, certain identification or action by a third party. The Provider does not act as a lawyer or represent the Client before an authority.

3. Pricing

Fees are set on the basis of a personalised quote, depending on the complexity of the case. Any quote accepted by the Client gives rise to a 50% deposit invoiced on signature, with the balance due on delivery of the report. Prices are expressed in Swiss francs (CHF), plus VAT where applicable (8.1% at the standard rate).

4. Turnaround time

An investigation takes on average 3 to 5 weeks from receipt of the complete information provided by the Client. This timeframe is indicative and may vary depending on complexity.

6. Confidentiality

The Provider contractually undertakes to keep information provided by the Client confidential and process it in accordance with the FADP (Federal Act on Data Protection).

7. Liability

The Provider’s liability is limited to the amount of fees actually received for the disputed service. No compensation is due for indirect losses (loss of earnings, moral damage, etc.).

8. Right of withdrawal

Under Swiss law, no automatic statutory right of withdrawal exists for distance contracts concluded between professionals. For consumers, a reflection period of 7 days may be granted on request, before the services actually begin.

9. Termination

In accordance with art. 404 CO, either party may revoke or terminate the mandate at any time. If termination occurs at an inopportune time, the party responsible must make good the damage caused.

10. Governing law — jurisdiction

This contract is governed by Swiss law. Jurisdiction lies at the registered seat of the Provider (Geneva), subject to mandatory consumer-protection provisions.
